2. Scope of This Policy
This Returns & Refunds Policy applies to all purchases made through gearup.ie and delivered within Ireland and the European Union.
This policy is designed to operate in conjunction with your statutory rights under Irish and EU consumer law. Where the law grants mandatory rights, those rights remain unaffected.
3. Right to Cancel (Distance Selling)
In accordance with EU consumer legislation, customers purchasing online have the right to cancel their order within 14 days from the day they receive the goods.
Conditions:
- Goods must be unused, unworn, and in original condition
- All original packaging, accessories, manuals, and labels must be included
- Proof of purchase is required
We reserve the right to refuse returns where goods show signs of use, damage, or incomplete packaging beyond what is necessary to inspect the item.
4. Non-Returnable Items
Unless required by law, we do not accept returns for:
- Used or assembled bicycles
- Items damaged due to misuse, neglect, or improper handling
- Custom-built, customised, or special-order items
- Items returned outside the 14-day return period
5. Return Process
To request a return, customers must:
- Contact us at hello@gearup.ie within 14 days of delivery
- Obtain return authorisation before sending any goods
- Return items securely packaged to prevent damage
Unauthorised returns may be refused or returned to the customer at their expense.
6. Return Shipping Costs
- Customers are responsible for return shipping costs, unless the item is defective or damaged on arrival
- Original delivery charges are non-refundable, unless required by law
- We do not accept responsibility for items lost or damaged in return transit
7. Damaged or Defective Goods
If goods are delivered damaged or defective, we will:
- Repair or replace the product at our discretion
- Cover the cost of repair, replacement, and re-delivery
Customers must notify us within 48 hours of delivery and provide:
- Order number
- Description of the issue
- Photographic evidence where possible
Failure to notify within this timeframe may result in the claim being declined.
8. Courier & Delivery Liability
We use third-party courier services for all deliveries.
We accept no liability for any loss, damage, shortage, or non-delivery of goods where the customer fails to comply with the carrier’s requirements, including but not limited to:
- Failure to report damage within the courier’s specified timeframe
- Failure to inspect goods upon delivery
- Failure to accept delivery or collect goods
Once goods are delivered or made available for collection, responsibility transfers to the customer.
9. Refunds
Where a refund is approved:
- Refunds will be issued to the original payment method
- Processing may take 5–10 working days after receipt and inspection of returned goods
- We reserve the right to deduct any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods
10. Bicycles
Due to the nature of bicycles:
- Once a bicycle has been assembled, ridden, or adjusted, it is considered used
- Used bicycles are not eligible for return, unless faulty
11. Local Store Returns
Where applicable, returns may be made in-store only with prior approval. Proof of purchase is required.
12. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect or consequential losses
- We are not responsible for delays caused by third-party couriers
- Our liability is limited to repair, replacement, or refund of the affected goods
13. Statutory Rights
Nothing in this policy limits or excludes your statutory rights under:
- Irish consumer law
- EU consumer protection legislation
